Lawyers said that he was detained illegally and his documents were confiscated without grounds

On November 22, Baku Appellate Court held two trials regarding the Chairman of the Azerbaijan Democracy and Welfare Party (ADR), professor Gubad Ibadoglu.

One of them was the extension of Gubad Ibadoglu’s detention period for another 3 months for the investigation period, and the other was related to the taking away of the documents of the party led by him after his detention and not returning them to this day.

On November 16, Judge Hafiz Kamranov in the Narimanov District Court extended the period of preventive detention for another 3 months, providing the prosecutor’s presentation about the ADR chairman.

The appeal against this decision was considered on November 22.

Lawyer Zibeyda Sadygova, while justifying her complaint, said that the accusations against Gubad Ibadoglu are unfounded.

Emphasizing that his client is innocent, the lawyer added that, moreover, he has serious health problems.

Being kept in closed conditions in the detention center, and the lack of access to medical care, which is important for him, lead to the deterioration of his health condition day by day.

Zibeyda Sadigova said that the investigation can be continued even without Gubad Ibadoglu being detained.

The investigator objected to this.

He said that the investigation has not yet been completed, a number of investigative actions should be carried out.

In this period, it is appropriate for Gubad Ibadoglu to remain in prison. Because in the case of release, there may be an opportunity to evade the investigation and influence the course of the investigation.

Gubad Ibadoglu himself said that he is innocent and that he was detained by order.

The Baku Appellate Court did not satisfy the appeal, the decision of the Narimanov District Court to extend the preventive measure by 3 months was upheld.

As for the issue related to the documents of the ADR party, the lawyers applied to the General Prosecutor’s Office and the Main Department of Combating Organized Crime of the Ministry of Internal Affairs. However, their appeals were not answered positively.

In this regard, the defenders submitted an application to the Narimanov District Court with a complaint in the order of judicial review.

In the application, it was requested that the institution conducting the investigation – the General Directorate for Combating Organized Crime, be obliged to return the party’s documents. However, the Narimanov District Court did not provide this either.

On November 22, during the hearing of the appeal on this issue at the Baku Appellate Court, lawyer Fakhraddin Mehdiyev said that the ADR party applied to the court some time ago due to the refusal of registration.

Currently, due to the ongoing court proceedings related to the registration problem, those documents are also needed.

Moreover, the party’s documents have nothing to do with the accusation of counterfeit money against Gubad Ibadoglu.

The appellate court did not satisfy Gubad Ibadoglu’s complaint regarding the return of documents.

Due to the exhaustion of domestic legal remedies for both issues and the appeal to the Supreme Court in such matters is not provided by law, the lawyers will appeal to the European Court.

Professor Gubad Ibadoglu, an invited lecturer at the London School of Economics, has been in prison since July 23.

On the same day, he was charged with Article 204.3.1 of the Criminal Code (when making, acquiring or selling counterfeit money or securities is committed by an organized group).

The chairman of ADR was previously accused of collusion with four other people. Their names were first announced in the Turkish media on the eve of Gubad Ibadoglu’s arrest.

These four people, who are presented as persons related to FETÖ (Fethullah Gülen Terrorist Organization), have been charged with the same charge as Gubad Ibadoğlu – Article 204.3.1 of the Criminal Code.

The four persons in question are Doyrush Jafarov, Gumrah Abdurakhmanov, Ruslan Aliyev and Anar Aliyev.

After the detention of Gubad Ibadoglu, it was claimed that Anar Aliyev mentioned his name in his statement. But Gubad Ibadoglu said that he did not know this person in general.

On the day Gubad Ibadoglu was detained, 40,000 dollars was found in the office, and it is claimed that part of it was fake. However, the chairman of ADR said that this money has nothing to do with him.

On August 25, a new charge was announced against him under Article 167-3.1 (Preparation, storage, dissemination of religious extremist materials) of the Criminal Code.

Gubad Ibadoglu said that this accusation was also absurd and refused to testify as a sign of protest.

On the day of his arrest, Gubad Ibadoglu said that he was arrested on the order of President Ilham Aliyev when he was taken out of the place after the search.

In addition, on August 6, Fazil Gasimov, an Azerbaijani scientist living in Turkey and working at a university there, was detained and brought to Azerbaijan.

On August 8, by the decision of the Narimanov District Court, a pretrial detention measure was chosen for him.

He was also charged with the same article.
